1. About Nour Premium

These Terms & Conditions (“Terms”) govern access to and purchases made through the Nour Premium online store (“Store”). “Nour Premium”, “we”, “us” and “our” refer to the legal entity operating the Store. The legal entity’s full details appear in Section 12.

By placing an order, you confirm that you have read and accepted these Terms, together with our Returns & Refunds Policy, Shipping & Delivery Policy and Privacy Policy.

2. Applicability and Consumer Rights

These Terms apply to consumer purchases made through the Store. Nothing in these Terms excludes, restricts or limits any mandatory consumer right, warranty, remedy or protection that cannot lawfully be excluded.

For customers in the European Union, mandatory consumer protections applicable in the customer’s country of habitual residence remain unaffected. For customers purchasing in the UAE, these Terms are subject to applicable UAE consumer-protection and e-commerce requirements.

Where a provision of these Terms is unenforceable under mandatory law, that provision will apply only to the extent legally permitted, without affecting the remaining provisions.

3. Products and Product Information

We make reasonable efforts to present product colours, materials, measurements and details accurately. Appearance may vary depending on the customer’s screen, device, lighting and photographic conditions.

Minor variations inherent to natural or textile materials do not constitute a defect where the product otherwise conforms to its description.

We may correct genuine errors in product descriptions, availability or pricing and may cancel an affected order where permitted by law. If payment has already been taken for a cancelled order, we will refund the amount paid.

4. Orders and Contract Formation

Placing an order constitutes an offer to purchase. An order is accepted when Nour Premium confirms acceptance or otherwise confirms that the order has been accepted.

We may refuse or cancel an order where permitted by applicable law, including where a product is unavailable, a material pricing or product-description error has occurred, payment cannot be authorised, or we reasonably suspect fraud or unauthorised activity.

Products are sold for personal, non-commercial use. Resale is not permitted without our prior written consent.

5. Prices, Taxes and Payment

The applicable price and any applicable taxes, delivery charges or other mandatory charges will be displayed at checkout or otherwise disclosed before the order is placed, as required by applicable law.

Payment must be completed using an available payment method at checkout. Cash on Delivery is not currently offered.

For cross-border orders, customs duties, import taxes or other charges may apply depending on the destination and the delivery arrangement. Where such charges are payable by the customer, this will be indicated before or during checkout where reasonably possible.

6. Delivery and Risk

We will provide the delivery options and estimated delivery times available for the destination at checkout.

Delivery dates are estimates unless a specific delivery date has been expressly agreed. We are not responsible for delays caused by events outside our reasonable control, including customs procedures or carrier disruption, subject to any mandatory rights applicable to the customer.

Risk of loss or damage passes to the customer upon delivery in accordance with applicable law. Nothing in these Terms limits any mandatory rights concerning non-delivery, late delivery, loss or damage during transportation.

7. Returns, Withdrawal and Refunds

Returns, refunds, exchanges and statutory withdrawal rights are governed by our Returns & Refunds Policy, which forms part of these Terms.

For European Union consumers, the statutory 14-day right of withdrawal applies to distance sales subject to applicable legal exceptions. For UAE and other GCC orders, change-of-mind returns are not offered except where required by applicable law.

Nothing in our Returns & Refunds Policy or these Terms limits mandatory remedies for defective, damaged, incorrect or non-conforming goods.

8. Product Conformity and Defects

Our products are supplied in accordance with applicable statutory requirements. If an item is defective, damaged, incorrect or does not conform to the contract, please contact us promptly at contact@nour-premium.com.

We will assess the issue and provide the remedy required by applicable law, which may include repair, replacement, price reduction or refund, as applicable.

Nothing in these Terms excludes or limits mandatory statutory warranties or liability that cannot legally be excluded.

9. Intellectual Property

All trademarks, names, logos, designs, photographs, graphics, text, videos and other content made available through the Store are owned by or licensed to Nour Premium and are protected by applicable intellectual-property laws.

You may use the Store for personal, non-commercial purposes only. No content may be reproduced, distributed, modified or commercially exploited without our prior written consent, except where permitted by law.

10. Liability

To the fullest extent permitted by applicable law, Nour Premium is not responsible for indirect or consequential losses arising from use of the Store or products.

Nothing in these Terms excludes or limits liability for matters that cannot legally be excluded or limited, including mandatory consumer rights, applicable product liability, fraud, or death or personal injury caused by negligence where such liability cannot lawfully be excluded.

11. Governing Law and Disputes

These Terms are governed by the law applicable to the Nour Premium contracting entity, without prejudice to mandatory consumer protections that apply in the customer’s country of habitual residence.

For consumers in the European Union, nothing in this clause deprives the consumer of protections or rights that cannot lawfully be excluded by agreement.

For UAE consumers, disputes will be subject to the competent courts of the United Arab Emirates, to the extent permitted by applicable law.

Nothing in this section prevents a consumer from relying on mandatory dispute-resolution, jurisdictional or consumer-protection rights available under applicable law.

13. Changes to These Terms

We may update these Terms from time to time. The version applicable to an order is the version available and accepted when that order is placed, unless a change is required by law.

If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.

1. نبذة عن نور بريميوم

تنظم هذه الشروط والأحكام («الشروط») استخدام متجر نور بريميوم الإلكتروني («المتجر») وعمليات الشراء التي تتم من خلاله. ويُقصد بعبارات «نور بريميوم» و«نحن» و«لنا» الكيان القانوني الذي يدير المتجر، وترد بياناته الكاملة في القسم 12.

عند إتمام الطلب، يقر العميل بأنه قرأ هذه الشروط ووافق عليها، إلى جانب سياسة الإرجاع واسترداد المبالغ وسياسة الشحن والتسليم وسياسة الخصوصية.

2. نطاق التطبيق وحقوق المستهلك

تنطبق هذه الشروط على مشتريات المستهلكين من خلال المتجر. ولا تستبعد هذه الشروط أو تقيد أو تحد من أي حق أو ضمان أو تعويض أو حماية إلزامية للمستهلك لا يجوز استبعادها أو تقييدها قانوناً.

بالنسبة للعملاء في الاتحاد الأوروبي، تظل حقوق حماية المستهلك الإلزامية المطبقة في بلد الإقامة المعتادة للعميل محفوظة. وبالنسبة للعملاء في دولة الإمارات العربية المتحدة، تخضع هذه الشروط لمتطلبات حماية المستهلك والتجارة الإلكترونية الإماراتية السارية.

إذا تبين أن أي حكم من هذه الشروط غير قابل للتنفيذ بموجب قانون إلزامي، فيطبق ذلك الحكم بالقدر الذي يسمح به القانون، دون التأثير في باقي الأحكام.

3. المنتجات ومعلومات المنتج

نبذل جهوداً معقولة لعرض ألوان المنتجات وموادها ومقاساتها وتفاصيلها بدقة. وقد يختلف المظهر باختلاف شاشة العميل أو جهازه أو الإضاءة أو ظروف التصوير.

لا تُعد الاختلافات البسيطة الملازمة للمواد الطبيعية أو الأقمشة عيباً إذا كان المنتج مطابقاً لوصفه.

يجوز لنا تصحيح الأخطاء الفعلية في وصف المنتجات أو توافرها أو أسعارها، وإلغاء الطلب المتأثر متى سمح القانون بذلك. وإذا تم تحصيل المبلغ بالفعل، فسنقوم برد المبلغ المدفوع.

4. الطلبات وإبرام العقد

يمثل تقديم الطلب عرضاً لشراء المنتج. ويُعد الطلب مقبولاً عند تأكيد نور بريميوم قبوله أو تأكيد قبول الطلب بأي وسيلة أخرى.

يجوز لنا رفض أو إلغاء الطلب في الحالات التي يسمح بها القانون، بما في ذلك عدم توافر المنتج، أو وجود خطأ جوهري في السعر أو وصف المنتج، أو تعذر اعتماد الدفع، أو وجود اشتباه معقول في الاحتيال أو الاستخدام غير المصرح به.

تُباع المنتجات للاستخدام الشخصي وغير التجاري. ولا يُسمح بإعادة بيع المنتجات دون موافقة كتابية مسبقة من نور بريميوم.

5. الأسعار والضرائب والدفع

يتم عرض السعر المطبق وأي ضرائب أو رسوم تسليم أو رسوم إلزامية أخرى في صفحة الدفع أو يتم الإفصاح عنها قبل إتمام الطلب وفقاً للقانون المطبق.

يجب إتمام الدفع باستخدام إحدى وسائل الدفع المتاحة عند إتمام الطلب. لا تتوفر حالياً خدمة الدفع عند الاستلام.

قد تخضع الطلبات العابرة للحدود للرسوم الجمركية أو ضرائب الاستيراد أو رسوم أخرى بحسب بلد الوجهة وترتيبات التسليم. وعندما يتحمل العميل هذه الرسوم، يتم توضيحها قبل أو أثناء إتمام الطلب متى كان ذلك ممكناً بصورة معقولة.

6. التسليم وانتقال المخاطر

نعرض عند إتمام الطلب خيارات التسليم ومواعيد التسليم التقديرية المتاحة للوجهة المحددة.

تُعد مواعيد التسليم تقديرية ما لم يتم الاتفاق صراحةً على تاريخ محدد. ولا نتحمل المسؤولية عن التأخير الناجم عن أحداث خارجة عن سيطرتنا المعقولة، بما في ذلك إجراءات الجمارك أو تعطل شركات النقل، مع مراعاة أي حقوق إلزامية للعميل.

تنتقل مخاطر فقدان المنتج أو تلفه إلى العميل عند التسليم وفقاً للقانون المطبق. ولا يحد أي حكم في هذه الشروط من الحقوق الإلزامية المتعلقة بعدم التسليم أو التأخير أو الفقد أو التلف أثناء النقل.

7. الإرجاع والعدول واسترداد المبالغ

تخضع عمليات الإرجاع واسترداد المبالغ والاستبدال وحقوق العدول القانونية لسياسة الإرجاع واسترداد المبالغ الخاصة بنا، والتي تشكل جزءاً من هذه الشروط.

بالنسبة لمستهلكي الاتحاد الأوروبي، يسري حق العدول القانوني لمدة 14 يوماً على المبيعات عن بُعد، مع مراعاة الاستثناءات القانونية. وبالنسبة لطلبات الإمارات العربية المتحدة ودول مجلس التعاون الخليجي الأخرى، لا نقبل الإرجاع لمجرد تغيير الرأي، إلا إذا كان القانون المطبق يقتضي خلاف ذلك.

لا تحد هذه الشروط أو سياسة الإرجاع واسترداد المبالغ من أي حقوق أو تعويضات إلزامية بشأن المنتجات المعيبة أو التالفة أو غير الصحيحة أو غير المطابقة

8. مطابقة المنتجات والعيوب

تُورّد منتجاتنا وفقاً للمتطلبات القانونية الإلزامية المطبقة. إذا كان المنتج معيباً أو تالفاً أو غير صحيح أو غير مطابق للعقد، يرجى التواصل معنا على contact@nour-premium.com في أقرب وقت ممكن.

سنقوم بتقييم الحالة وتقديم التعويض الذي يقتضيه القانون المطبق، والذي قد يشمل الإصلاح أو الاستبدال أو تخفيض السعر أو استرداد المبلغ، حسب الحالة.

لا تستبعد هذه الشروط أو تحد من أي ضمانات أو مسؤوليات قانونية إلزامية لا يجوز استبعادها قانوناً.

9. الملكية الفكرية

جميع العلامات والأسماء والشعارات والتصاميم والصور والرسومات والنصوص ومقاطع الفيديو والمحتويات الأخرى المتاحة من خلال المتجر مملوكة لنور بريميوم أو مرخصة لها، وتحميها قوانين الملكية الفكرية المطبقة.

يجوز استخدام المتجر لأغراض شخصية وغير تجارية فقط. ولا يجوز نسخ أو توزيع أو تعديل أو استغلال أي محتوى تجارياً دون موافقة كتابية مسبقة، إلا في الحالات التي يسمح بها القانون.

10. المسؤولية

في حدود ما يسمح به القانون المطبق، لا تتحمل نور بريميوم المسؤولية عن الخسائر غير المباشرة أو التبعية الناشئة عن استخدام المتجر أو المنتجات.

ولا يستبعد أي حكم في هذه الشروط أو يحد من المسؤولية التي لا يجوز استبعادها أو الحد منها قانوناً، بما في ذلك حقوق المستهلك الإلزامية ومسؤولية المنتجات المقررة قانوناً والاحتيال والوفاة أو الإصابة الشخصية الناجمة عن الإهمال حيث لا يجوز استبعاد هذه المسؤولية قانوناً.

11. القانون المطبق وتسوية النزاعات

تخضع هذه الشروط للقانون المطبق على الكيان المتعاقد مع العميل في نور بريميوم، دون الإخلال بحماية المستهلك الإلزامية المطبقة في بلد الإقامة المعتادة للعميل.

بالنسبة لمستهلكي الاتحاد الأوروبي، لا يحرم هذا الحكم العميل من أي حماية أو حقوق لا يجوز استبعادها قانوناً بموجب الاتفاق.

بالنسبة لمستهلكي دولة الإمارات العربية المتحدة، تخضع النزاعات لاختصاص المحاكم المختصة في دولة الإمارات العربية المتحدة، في حدود ما يسمح به القانون المطبق.

ولا يمنع هذا القسم المستهلك من الاستفادة من أي حقوق إلزامية تتعلق بالاختصاص القضائي أو تسوية النزاعات أو حماية المستهلك متاحة له بموجب القانون المطبق.

بالنسبة للعملاء في الاتحاد الأوروبي، تتوفر بيانات تعريف التاجر وبيانات الاتصال المطلوبة بموجب قانون حماية المستهلك قبل إتمام الطلب.

وبالنسبة للعملاء في دولة الإمارات العربية المتحدة، يتم توفير المعلومات المطلوبة المتعلقة بالنشاط التجاري والمستهلك باللغتين العربية والإنجليزية.

 

13. تعديل الشروط

يجوز لنا تحديث هذه الشروط من وقت لآخر. وتطبق على الطلب النسخة السارية والمقبولة عند إتمامه، ما لم يكن التعديل مطلوباً بموجب القانون.

إذا تبين أن أي حكم غير صالح أو غير قابل للتنفيذ، تظل بقية الأحكام سارية.
